Terms and Conditions
Effective July 12, 2026

These Terms govern Nova accounts, friends, messages, support, creator tools, projects, published games, multiplayer, tokens, reservations, websites, and related features. Nova is operated under the Nova name. Questions can be sent to cmofficalbusiness@gmail.com.

1Agreement

By creating an account, checking the Terms box, accessing Nova, playing or publishing a game, joining multiplayer, sending a message, or using a creator tool, you agree to these Terms. The Privacy Policy explains Nova's data practices and is incorporated by reference.

If you do not agree, do not create an account or use Nova. Material updates may require account users to review the updated Terms and Privacy Policy through the normal sign-in or Home flow.

2Eligibility

You must be at least 13 years old to create an account or use Nova. By checking the signup box, you confirm that you are at least 13.

If you are under the age of legal majority where you live, you may use Nova only with permission from a parent or legal guardian who has reviewed these Terms. Nova does not currently provide a real-money checkout. If paid features are added, minors may use them only with legally valid guardian permission.

If Nova learns that an account does not satisfy these rules, Nova may disable or delete it. A parent or guardian can contact Nova about an under-13 account.

3Privacy

The Privacy Policy describes the account, social, support, creator, multiplayer, browser-storage, and network information Nova processes; where it may be visible; the providers involved; and how to request access, correction, or deletion.

Do not submit a real name, contact details, location, credentials, or other sensitive information in a username, chat, support message, project, upload, or game unless it is necessary and you are authorized to share it.

4Accounts

You are responsible for your username, password, device, and activity through your account. Nova's standard account uses a one-way password hash and currently has no email-based recovery. Use a unique password and do not share it.

  • Do not use someone else’s account without permission.
  • Do not share your account in a way that causes harm or misuse.
  • Do not bypass locks, limits, permissions, or security features.
  • Do not attack, overload, copy, scrape, reverse engineer, or interfere with Nova.

Do not use another person's account, impersonate another person, or reserve a misleading username. Notify Nova if you believe an account has been compromised. Nova may require password verification or other reasonable proof before changing or deleting account data.

5Nova IP

Nova and its licensors retain rights in the Nova name, logos, platform code, interface, documentation, templates, and assets supplied by Nova. These Terms do not transfer those rights to users.

Nova gives you a limited, personal, non-exclusive, non-transferable, revocable right to use the platform and Nova-supplied materials only through the features Nova provides and only while you follow these Terms.

You may not copy, sell, scrape, extract, bypass access controls, or redistribute Nova's platform or supplied assets except where applicable law permits it or Nova gives written permission. These limits do not claim ownership of general ideas, game mechanics, or your original content.

6Created Content

You retain ownership of original content you create or upload, subject to any rights in Nova-supplied materials, third-party content, and the rights you grant below. Using Nova's tools does not by itself transfer ownership of your original work to Nova.

You grant Nova a worldwide, non-exclusive, royalty-free license to host, store, copy, format, adapt, execute, display, perform, transmit, and distribute your content only as reasonably needed to operate, secure, improve, and provide Nova, and to publish or promote inside Nova any content you choose to make public.

This license lasts while the content is stored or published through Nova. It may continue for reasonable backups, legal compliance, safety evidence, and copies already shared with others. Where technically and legally feasible, Nova will stop new public use after deletion.

7Uploads

You may provide project names, code, HTML, images, audio, cover art, files, and other content for projects or published games. Public content may identify your Nova username as the creator.

You are responsible for your content and for deciding whether to save it locally, store it in Nova, share it with a recipient, or publish it.

  • You promise that you own the content or have permission to use it.
  • You promise that it does not violate copyright, trademark, privacy, publicity, or other rights.
  • You promise that it does not contain malware, hidden tracking, credential collection, illegal content, or material that endangers, exploits, harasses, or deceives others.
  • You are responsible for claims caused by your upload.

Nova may remove, disable, or preserve content when reasonably needed to address safety, infringement, platform integrity, a legal request, or a Terms violation. Rights holders can send a detailed complaint to Nova Support.

8User Rules

You may not use Nova to harass, threaten, bully, stalk, dox, exploit, or endanger another person; promote hatred or violence; share sexual or exploitative content; expose private information; infringe intellectual-property rights; distribute malware or hidden tracking; collect credentials; cheat; exploit bugs; manipulate scores or tokens; send spam; disrupt gameplay or networks; access private systems; evade enforcement; use unauthorized bots or scraping; or violate law.

Multiplayer peers and message recipients are real people. Do not share private contact or location information, and do not attempt to identify or track another player through network data. Report safety, copyright, or abuse concerns to Nova Support with enough detail to investigate.

Nova may remove or unpublish content, cancel invitations or reservations, restrict features, preserve relevant evidence, suspend accounts, or terminate access when Nova reasonably believes these rules were violated or action is needed to protect users, providers, or the service. Nova does not promise automated or advance moderation of every game or message.

9NovaShop

Nova currently provides a browser-local demo token balance. The visible $5, $10, and $20 controls do not currently charge money or use a payment processor. Reservations and creator pricing may use tokens as an in-platform counter.

  • Tokens and digital items are for use only inside Nova.
  • They have no cash value.
  • They cannot be exchanged for real money.
  • They cannot be transferred unless Nova allows it.
  • They may be changed, limited, removed, or discontinued by Nova.
  • They are not guaranteed to create income, attention, popularity, success, or better game performance.

If Nova later offers a real-money purchase, the price, seller, payment provider, recurring terms if any, and applicable refund information will be shown before payment. Nothing in these Terms limits refund or cancellation rights required by law.

10No Guarantee

Nova may allow games to be created, uploaded, published, invited, reserved, shared, tested, or played. Nova does not guarantee approval, publication, compatibility, performance, player counts, promotion, income, popularity, feedback, reservation availability, or permanent availability.

Creator tools and user code can fail, behave differently across devices, or be removed when unsafe or incompatible. Keep your own copies of important source files and assets.

11Availability

Nova is provided "as is" and "as available." It is an evolving platform, and Nova may add, change, pause, limit, or remove a feature when reasonably necessary.

To the fullest extent permitted by law, Nova does not guarantee uninterrupted availability, error-free operation, compatibility, security, data preservation, matchmaking, relay capacity, or that user content will be safe or accurate.

Mandatory warranties and consumer rights that cannot legally be excluded still apply.

12Data Security

No account system, browser storage, database, or peer-to-peer connection is perfectly secure. You are responsible for reasonable precautions on your device, while Nova remains responsible for obligations that applicable law places on the operator.

The Privacy Policy explains the safeguards, current password-hash design, network processing, deletion limits, and how to report a privacy concern. These Terms do not waive a right or remedy that applicable law says cannot be waived.

13Third Parties

Nova currently relies on Google Firebase and Firestore, Firebase anonymous authentication in one character tool, Google Fonts and STUN, Netlify hosting and functions, and Cloudflare Realtime TURN. Multiplayer may also connect browsers directly through WebRTC.

Third-party services have their own terms and privacy practices. Nova is not responsible for third-party content or outages outside Nova's reasonable control, but this does not remove responsibilities Nova has under applicable law.

14Termination

Nova may suspend, restrict, or terminate access, or remove content, when Nova reasonably believes a user violated these Terms, created a safety or legal risk, harmed another person or provider, or misused the service. Where practical and appropriate, Nova may provide notice or a chance to contact Support.

You may stop using Nova at any time and may use Settings to delete the core account. That control does not automatically remove every project, published game, reservation, older chat, multiplayer record, provider backup, or browser-local item; the Privacy Policy explains the current limits and how to request a broader review.

Provisions concerning ownership, licenses needed for retained copies, enforcement evidence, disclaimers, liability, disputes, and other terms that should reasonably survive will continue after access ends.

15Liability

To the fullest extent permitted by law, Nova and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, opportunity, progress, data, content, or goodwill arising from use of Nova.

To the fullest extent permitted by law, Nova's total liability for a claim will not exceed the greater of the amount actually paid to Nova for the affected service during the twelve months before the event or $50. This limit does not apply where prohibited, including liability that cannot legally be limited.

16Indemnity

To the extent permitted by law, you are responsible for third-party claims caused by your unlawful content, your intentional misuse of Nova, or your material violation of these Terms. This section does not require a minor to assume an obligation that cannot legally be enforced and does not limit consumer rights.

17Updates

Nova may update these Terms to reflect platform, provider, safety, or legal changes. Nova will change the effective date and may require account users to review and accept the updated Terms and acknowledge the updated Privacy Policy through the normal sign-in or Home flow.

Changes apply prospectively from the stated effective date unless law requires otherwise.

18Disputes

Before filing a formal claim, contact Nova with a description of the dispute and allow 30 days for an informal resolution, unless urgent relief or applicable law permits otherwise.

These Terms are governed by New Jersey law, without regard to conflict-of-law rules. Subject to mandatory consumer protections and any small-claims right, claims may be brought in a state court in Ocean County, New Jersey, or a federal court with jurisdiction there.

Nothing here deprives a consumer of non-waivable protections or a forum that applicable law requires.

19General Terms

To the fullest extent permitted by law, claims should be brought on an individual basis. This provision does not apply where a class, representative, collective, or public-injunction waiver is prohibited or unenforceable.

If any part of these Terms is unenforceable, the remaining terms continue. Nova's failure to enforce a term is not a waiver. You may not transfer an account or these Terms without permission; Nova may transfer these Terms as part of a lawful reorganization or service transfer.
